November 27 Appeals Court Victory in Western New York Injunction Case In the spring of 1999 Operation Save America came to Western New York to raise the unchanging standard of Jesus Christ on the streets of Buffalo and Rochester. We gathered to declare Jesus Christ as Lord at area abortion facilities. The positive fruit of that visit is still being harvested. Two abortion clinics at The Genesee Hospital closed and The Genesee Hospital, a pro-abortion hospital, went bankrupt and also closed.
To counter this peaceful pro-life witness in Western New York, Planned Parenthood and the Pro-Choice Network used the pro-abortion NY State Attorney General, Elliot Spitzer and Federal Judge Richard Arcara to move against Rescue Rochester, Last Call Ministries and Operation Rescue National et. al. Federal Judge Richard Arcara put in place one of the most restrictive anti-pro-life speech injunctions in the nation. Pro-life sidewalk counselors were moved from the sidewalk in front of local abortuaries in Buffalo and Rochester and placed across busy 4 lane highways. Amplification devices were denied. The radical defenders of death sought to crush any gospel and pro-life witness and these decriminalized places of death and suffering. Praise God for pro-life attorneys Mary Aramini and Chris Ferrara who battled the NY State Attorney General's office and The Pro-Choice Network and a hostile court. Many times it was Mary Aramini one on three during long injunction hearings. Attorney Chris Ferrara of the American Catholic Lawyers Association (ACLA) and Attorney Vince McCarthy of the American Center for Law and Justice (ACLJ) argued the appeal of this case before the US 2nd Circuit Court in New York City in March of 2001. They sought to have this dracrconian decision by Mr. Arcara overturned. Today we heard the results that a 3-judge panel that sits in NYC granted a measure of relief. Judge Arcara's pro-abortion bias has again been exposed. This marks another time a higher court has slapped his pro-abortion hand and said that he has gone too far. We are again allowed to stand on a public sidewalk and on the same side of the street near to where children are scheduled to die in Western New York abortion facilities. We are again allowed to use amplifiers and sound equipment to raise our voices in defense of life and in praise to Jesus Christ. This is a victory for the children and their moms and dads. It will be easier for them to get needed information regarding the true choices they face as they consider abortion. Lord willing, we will continue to have a pro-life presence at area abortion clinics until abortion joins slavery as an atrocity that has been eradicated from our nation.
